Terms of service.

Regarding all sessions must be paid in full at least 24 hours prior to the scheduled shoot date. This updated policy is designed to minimize last-minute cancellations and ensure a smooth experience for all clients.
To secure your booking, a non-refundable deposit of 50% of the total session cost is required. The remaining balance must be paid no later than 24 hours before the shoot. This ensures an easy going shoot day for both parties, with payment already settled.
Cancellations made within 48 hours of the scheduled shoot date will be eligible for rescheduling without a $75 charge. Anything after 48 hours will have a $75 charge. 
Clients are responsible for communicating a vision they have for the session and providing inspiration ahead of time to ensure the best possible results from the session. If do not have any, vision board will be provided by from photographer, Lexye Rae. 
Additional images are available for purchase. Raw images are never for purchase. 
Any studios or location rental fees are the responsibility of the client unless otherwise agreed upon in writing by both parties.
Both a signed print release form and a contract are required before the shoot date.
- All shoots require a consultation before final pricing.
- I reserve the right to decline projects if vision is not aligning.

Consultations:

- All clients must sign a model release form and contract day of booking. 
- Lexye Rae Studios retains the right to use images for portfolio and promotional purposes only.
- Clients who do not wish to allow image sharing, will be referred to other photographers.

Contracts and Model Release:

- A minimum of 72 hours’ notice is required for rescheduling.
- Rescheduling is subject to availability and cannot be guaranteed near the original date.
- Exceptions may be made for emergencies only.
- If weather impacts an outside shoot and an alternative venue is not available the shoot will be rescheduled for another date.

Rescheduling:

- There are NO REFUNDS on deposits once a date is booked and contract is signed.

Cancellation Policy:

- Prices for all sessions are listed under “Pricing” tab. 
- Additional costs apply for multiple subjects or group shoots.
- Lexye Rae Studios is a Black and White photographer. Clients who want colored images, will be charged extra.

Packages and Pricing:

Brands and events: 

- Base rate starts at $650, with additional hourly rates applied.

Collaborations:

- Collaborative shoots are by invitation only and limited to 12 images per collaboration.

Film Photography:

- Film shoots are available upon request for an additional fee.
- Costs for film and development will be added into cost of session.

Image Delivery:

- Turnaround time for digital final edited images is 1-3 weeks after the shoot.
- Turnaround time for film final images is 3-4 weeks after the shoot.
- High-end retouching is included in told packages only.
- Lexye Rae Studios liability is strictly limited to the amount paid for the photography services.
- While the Lexye Rae Studios takes all reasonable precautions, Lexye Rae Studios is not liable for any indirect, consequential, or incidental damages arising from the photography services or the use of the images.
- Clients agree to indemnify and hold Lexye Rae Studios harmless against any claims arising from their use of the images.
- This limitation of liability does not apply to any damages caused by gross negligence or willful misconduct.

Limitation of Liability:

- Lexye Rae Studios retains full copyright ownership of all images produced during the session.
- Clients are granted a limited, non-exclusive license for personal use of the images discussed in contract.
- This license does not include the right to sell, publish, or use the images for commercial purposes without express written permission from Lexye Rae Studios.
- Any unauthorized use, reproduction, or distribution of the images is strictly prohibited and will result in legal action.

Copyright and Usage:

- In the event of any dispute arising from or relating to these terms or the photography services, the parties agree to first attempt to resolve the dispute through direct communication. 
- If negotiation is unsuccessful, both parties agree to mandatory mediation before pursuing any other legal remedies.
- Mediation shall take place in Maricopa County, Arizona, with a mutually agreed-upon mediator.
- The costs of mediation shall be shared equally between the parties unless otherwise agreed.
- If mediation fails to resolve the dispute, either party may then pursue legal action in the courts of Maricopa County, Arizona.

Jurisdiction:

-  These terms and conditions shall be governed by and construed in accordance with the laws of the State of Arizona. Any legal action or proceeding arising out of or relating to these terms shall be brought exclusively in the courts of Maricopa County, Arizona.
